STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT establishing a committee to study animal welfare in New Hampshire.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.  There is established a committee to study the humane treatment of animals in New Hampshire.

2  Membership and Compensation.

I.  The members of the committee shall be as follows:

(a)  Four members of the house of representatives, one of who shall be a member of the fish and game and marine resources committee, two of whom shall be members of the environment and agriculture committee, and one of whom shall be a member of the criminal justice and public safety committee, appointed by the speaker of the house of representatives.

(b)  One member of the senate, appointed by the president of the senate.

II.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3  Duties.  The committee shall:

I.  Study the humane treatment of animals in New Hampshire in order to determine if existing New Hampshire laws and rules for domestic animals, livestock, and wildlife are reasonable, adequate, and consistent with the federal Animal Welfare Act and if such laws and rules are being adequately enforced.

II.  Research and recommend additional laws and rules that may prevent and address animal cruelty and neglect.

III.  Consult with the New Hampshire department of agriculture, markets, and food; the New Hampshire fish and game department; and the New Hampshire division of state police to evaluate state laws and rules to ensure the safety and welfare of domestic animals, livestock, and wildlife.

IV.  Research, evaluate, and determine possible funding sources for animal-cruelty related costs.  Funding needs may include, but not be limited to: the housing, transportation, and care for seized animals; professional training; and law enforcement and judicial system costs related to cruelty cases.

4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named house member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Four members of the committee shall constitute a quorum.

5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2018.

6  Effective Date.  This act shall take effect upon its passage.
