AN ACT prohibiting the use of flavors and certain chemicals in vaping products.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT prohibiting the use of flavors and certain chemicals in vaping products.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Statement of Intent. The general court recognizes that flavored vaping products encourage teenagers to use vaping products, therefore, the general court hereby prohibits the sale of any flavors, except menthol, in any vaping or electronic cigarette products.
2 New Section; Youth Access to Tobacco Products; Flavors and Chemicals in E-Liquids. Amend RSA 126-K by inserting after section 4-a the following new section:
126-K:4-b Certain Flavors and Chemicals Prohibited in E-Liquids. Flavors, except menthol, are prohibited in e-cigarettes and other vaping products. In addition, no chemicals shall be added to e-liquids or other vaping products which are prohibited for use as a food additive by the federal Food and Drug Administration or known to cause disease when inhaled in concentrations achieved by vaping.
3 New Section; Alcoholic Beverages; Tobacco Products; E-Liquids. Amend RSA 175 by inserting after section 5-b the following new section:
175:5-c Certain Flavors and Chemicals Prohibited in E-Liquids. Flavors, except menthol, are prohibited in e-cigarettes and other vaping products. In addition, no chemicals shall be added to e-liquids or other vaping products which are prohibited for use as a food additive by the federal Food and Drug Administration or known to cause disease when inhaled in concentrations achieved by vaping.
4 Effective Date. This act shall take effect January 1, 2021.
