AN ACT establishing a commission to study long-term supports and services in New Hampshire.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT establishing a commission to study long-term supports and services in New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Commission to Study Long-Term Supports and Services in New Hampshire. Amend RSA 126-A by inserting after section 80 the following new subdivision:
Commission to Study Long-Term Supports and Services in New Hampshire
126-A:81 Commission to Study Long-Term Supports and Services in New Hampshire Established.
I. There is established a commission to study long-term supports and services in New Hampshire.
(a) The members of the commission shall be as follows:
(1) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(2) One member of the senate, appointed by the president of the senate.
(3) The insurance commissioner, or designee.
(4) The commissioner of the department of health and human services, or designee.
(5) A representative from the state commission on aging, appointed by the commission.
(6) A member representing home health workers, appointed by the Granite State Home Health Association.
(7) The executive director of AARP New Hampshire, or designee.
(8) A representative of the New Hampshire Association of Counties, appointed by the association.
(9) A representative of the New Hampshire Disability Rights Center, appointed by the center.
(10) A public member representing a nonprofit social services organization for the elderly and disabled, appointed by the governor.
(11) The executive director of Granite State Independent Living, or designee.
(12) A representative of the New Hampshire chapter of the National Academy of Elder Law Attorneys, Inc, appointed by that organization.
(13) A representative of the New Hampshire Health Care Association, appointed by the association.
(b) Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
II.(a) The commission shall study improving the means of providing and funding long-term supports and services. The study shall include an examination of the following:
(1) The spectrum of long-term supports and services and delivery settings as they relate to health care and daily living.
(2) The implication of choice in settings for providing long-term supports and services.
(3) Costs and funding for long-term supports and services.
(4) The costs of options for persons who are not currently eligible for the Medicaid program.
(5) Long-term care insurance premiums.
(6) Other matters relevant to the commission's study.
(b) The commission may solicit input from any person or entity the commission deems relevant to its study.
III. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Eight members of the commission shall constitute a quorum.
IV. The commission shall submit a report with its findings and any recommendations for proposed legislation on or before November 1, 2021 to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.
2 Repeal. RSA 126-A:81, relative to commission to study long-term care supports and services in New Hampshire, is repealed.
I. Section 2 of this act shall take effect November 1, 2021.
II. The remainder of this act shall take effect upon its passage.
