STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to autism spectrum disorder insurance coverage.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 Coverage for Treatment of Pervasive Developmental Disorder or Autism.  Amend RSA 417-E:2, III to read as follows:

III.  The policy, contract, or certificate may limit coverage for applied behavior analysis to [$36,000] $40,000 per year for children 0 to 12 years of age, and [$27,000] $31,000 from ages 13 to 21, both of which shall be adjusted annually for cost of living increases.  An insurer may not apply payments for coverage unrelated to autism spectrum disorders to any maximum benefit established under this paragraph.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill increases the insurance coverage limit for autism spectrum disorder an provides the limit shall be adjusted annually for cost of living increases.  The Insurance Department indicates this may place inflationary pressure on claims costs, which may result in increased insurance premiums and premium tax revenue.

 

The Department of Administrative Services states the State Health Benefit Plan for employees and retirees is a governmental self-insured plan and is not governed by managed care law.  There would be no fiscal impact on the State Health Benefit Plan.

 

The Department of Health and Human Services indicates this bill would have no impact on the Medicaid program.

 

It is assumed this bill will not take effect until FY 2021.
