AN ACT relative to forwarding addresses of tenants in landlord tenant actions.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to forwarding addresses of tenants in landlord tenant actions.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Actions Against Tenants; Writ of Summons; Address.  Amend RSA 540:13 by inserting after paragraph III the following new paragraph:

III-a.  After a landlord makes a claim for unpaid rent or damages following service under paragraph III, the tenant shall be required to file and maintain a current forwarding address or legal address with the court in which the action was taken if the address changed following service, until the date of judgment under RSA 540:14.  A tenant who files a false address or who fails to maintain a current forwarding or legal address shall be subject to the penalty for violation of a court order.

2  New Paragraph; Actions Against Tenants; Judgment; Address.  Amend RSA 540:14 by inserting after paragraph III the following new paragraph:

III-a.  If the plaintiff makes a successful claim for unpaid rent and/or damages, the court shall require the tenant to file with the court a forwarding address or legal address to be maintained for 90 days from the date of the judgment.  A tenant who files a false address or who fails to maintain a current forwarding or legal address shall be subject to the penalty for violation of a court order.

3  Effective Date.  This act shall take effect January 1, 2019.
