AN ACT relative to investigations of sudden undetermined infant deaths (SUID) by the office of the chief medical examiner.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to investigations of sudden undetermined infant deaths (SUID) by the office of the chief medical examiner.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Office of the Chief Medical Examiner; Investigations of Sudden Undetermined Infant Deaths (SUID).  Amend RSA 611-B by inserting after section 22 the following new section:

611-B:22-a  Investigations of Sudden Undetermined Infant Deaths (SUID).

I.(a)  In sudden undetermined infant deaths (SUID) with recent vaccine administration, within 30 days, the medical examiner shall thoroughly investigate for potential vaccine-related adverse reactions and its correlation to the death by performing appropriate blood, organ, and tissue studies to identify potential vaccine-related components.

(b)  In all probable anaphylaxis-related and encephalitis-related infant deaths, the medical examiner shall thoroughly investigate for potential vaccine-related adverse reactions and the correlation to death.

(c)  Where applicable, vaccine related ICD Codes shall be recorded for example, T80.52 Anaphylactic reaction due to vaccination and T88.1 Other complications following immunization.  The death certificate and related autopsy records shall reflect the vaccine-related complications as a probable, an underlying, or cause of death.

(d)  The next of kin shall be entitled to copies of documents prepared pursuant to this section.

(e)  The medical examiner shall accurately record and report such screenings and findings on all SUID investigations performed pursuant to this section to the child fatality review committee, established under RSA 132:41 on an annual basis.

2  Effective Date.  This act shall take effect upon its passage.

The Department of Justice was contacted on November 7, 2019 for a fiscal note worksheet, which they have not provided as of December 17, 2019.

 

METHODOLOGY:

This bill requires the state medical examiner to investigate all sudden undetermined infant deaths for potential vaccine-related correlations.  The Department of Health and Human Services states the bill will not impact its responsibilities, and as such the bill will have no fiscal impact on the Department.
