AN ACT relative to enforcement activity verifying compliance.

This bill requires the liquor commission to make rules about points imposed for compliance failures.  

 

This bill also requires training for servers serving alcohol.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to enforcement activity verifying compliance.

 

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Enforcement Activity Verifying Noncompliance.  Amend RSA 179:5-b to read as follows:

179:5-b  Enforcement Activity Verifying Noncompliance.

I.  It shall be a violation to sell any liquor or beverage to a minor during enforcement activity initiated solely for the purpose of verifying noncompliance with RSA 179:5.  It shall be a misdemeanor to knowingly sell liquor or beverage to a minor at the time of any such enforcement activity.  The commission shall retain the right to require the licensee in such a circumstance to initiate additional training of its staff or individual employee.  This section shall not apply to law enforcement initiatives involving surveillance, investigations, or criminal complaints of prohibited sales.

II.  The commission shall make rules relative to violations that result from enforcement activity in paragraph I.  Such rules shall include a system in which points are imposed for noncompliance.  Such points shall be valid for 3 years from the date of their imposition.  

2  New Subparagraph; Mandatory Training for Servers.  Amend RSA 178:2, IV by inserting after subparagraph (b) the following new subparagraph:

(c)  Within 30 days of the date of hire, the training program shall be attended by any person serving alcohol in the establishment owned by the licensee.  

3  Effective Date.  This act shall take effect 60 days after its passage.
