AN ACT relative to the suspension of a driver's license and limiting 20-day registration plates.

ANALYSIS

 

This bill limits the 20-day registration plates used for the same vehicle to 3 plates within a 12-month period.  This bill also authorizes the director of the division of motor vehicles to suspend or revoke the driver's license of a person whose driver's license or right to operate has been suspended or revoked in another jurisdiction.

 

This bill was requested by the department of safety.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to the suspension of a driver's license and limiting 20-day registration plates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Twenty-Day Registration.  Amend RSA 261:57, I to read as follows:

I.  Any resident of this state who intends to purchase a vehicle in another state or from another person or who is unable to register a vehicle because of limited hours of operation of the town clerk in the town where the person resides may apply to the division or its substation or authorized agent nearest his or her residence for a registration to drive said vehicle on the ways of the state in an unregistered condition.  Said resident shall appear in person at the division or substation to obtain such registration and shall sign under penalty of perjury a statement that the vehicle meets all New Hampshire inspection requirements, and in the case of a person seeking an extension of his or her registration, that he or she was unable to register the vehicle because of the limited hours of the town clerk, before said registration may be issued.  Said registration shall be valid for 20 days from the time it is issued.  Application blanks and permits in the form prescribed by the director shall be designed, printed, and supplied to the substations by the division.  The fee for the issuance of a registration shall be $10.  It shall be unlawful for any person to drive a vehicle on the ways of the state under a registration issued pursuant to this section unless said person has in his or her possession a valid bill of sale for the vehicle he or she is driving, or in the case of a person whose registration is extended, a copy of the form indicating he or she was unable to register because of the limited hours of the town clerk.  No person shall make application for a 20-day registration on the same vehicle more than once within a 12-month period.  Only 3 20-day registrations shall be issued on the same vehicle within a 12-month period.

2  New Section; Suspension or Revocation in Another Jurisdiction.  Amend RSA 263 by inserting after section 56-f the following new section:

263:56-g  Suspension or Revocation in Another Jurisdiction.  Upon receipt of official notice, in any form which the director deems appropriate, including electronic transmissions, that a driver licensed by the state of New Hampshire, or any applicant for a driver's license in the state of New Hampshire, has had a driver's license or right to operate suspended or revoked in another state, country, or jurisdiction, the director shall not issue a license to the person and, if a license has already been issued, the director shall immediately suspend or revoke the license without a hearing.  If the director revokes or suspends a driver's license under this section, the driver, upon written application to the department, shall be granted a hearing by the department within 15 days after the filing of the application.  If the other state, country, or jurisdiction has reinstated or subsequently reinstates the license or right to operate of the person, he or she may apply to the director for reinstatement of the license in the state of New Hampshire.

3  Effective Date.  

I.  Section 1 of this act shall take effect 60 days after its passage.

II.  The remainder of this act shall take effect upon its passage.
