AN ACT relative to integrated pest management for school grounds.

ANALYSIS

 

This bill:

 

I.  Prohibits the application of pesticides on school grounds unless certain procedures are followed.

 

II.  Requires notice of the application of certain pesticides.

 

III.  Requires the division of pesticide control to manage a public database of pesticide applications at schools.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to integrated pest management for school grounds.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Integrated Pest Management on School Grounds.  Amend RSA 430 by inserting after section 57 the following new subdivision:

430:58  Integrated Pest Management on School Grounds.

I.  No individual shall apply a pesticide to the grounds of any school, including athletic fields and playgrounds, unless the school has an integrated pest management plan.  Any application of pesticides shall:

(a)  Be consistent with the integrated pest management plan.

(b)  Be publicly noticed in accordance with rules established by the pesticide control board.

(c)  Be reported to the division of pesticide control within 7 days with the following information:

(1)  The identity of the pesticide applied, including both the active ingredient and the label name and manufacturer

(2)  The amount of the application.

(3)  The location of the application.

(4)  The time and date of application.

(d)  If the pesticide is labeled with an Environmental Protection Agency signal word of warning or danger, or with established carcinogenic, mutagenic, teratongenic, or endocrine disrupting properties, require a detailed explanation of why a lower risk pesticide cannot be used instead and require prior authorization by the pesticide control board.

II.  Any application of pesticides to school grounds shall be publicly noticed in advance in accordance with rules established by the pesticide control board.

III.  The division of pesticide control shall maintain a publicly accessible database of all applications of pesticides to school grounds.  

2  New Subparagraphs; Pesticide Board.  Amend RSA 430:31, IV by inserting after subparagraph (y) the following new subparagraphs:

(z)  Public notice requirements in advance of pesticide production.

(aa)  Maintenence of a publicly accessible database of all applications of pesticides to school grounds.

3  Effective Date This act shall take effect 60 days after its passage.
