STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to motorcycle registration for a period of less than one year.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Motor Vehicles; Certificates of Title and Registration of Vehicles; General Registration; Expiration of Registration.  Amend the introductory paragraph of RSA 261:62, II to read as follows:

II.  The registration of every other vehicle, except as provided in paragraph III, shall expire at midnight on the last day of the month in which the first anniversary of the registrant's birth following the date of issue is observed, provided that:

2  Motor Vehicles; Certificates of Title and Registration of Vehicles; General Registration; Expiration of Registration.  Amend RSA 261:62, III to read as follows:

III.  The registration of every motorcycle registered pursuant to RSA 261:57-c shall expire on the last day of the expiration month chosen by the registrant, provided that such registrations shall expire no later than the last day of the sixth month following the date of issue.

IV.  Notwithstanding any other provisions of law to the contrary, the director is authorized to designate the expiration month for the registration of any vehicles registered under the provisions of the international registration plan, should New Hampshire become a member of the IRP.

3  New Section; Motor Vehicles; Certificates of Title and Registration of Vehicles; General Registration; Seasonal Motorcycle Registration.  Amend RSA 261 by inserting after section 57-b the following new section:

261:57-c  Seasonal Motorcycle Registration.

I.  The owner of any motorcycle intended to be driven seasonally may apply to the division for the issuance of a seasonal motorcycle registration for such vehicle.  Application shall be made on a form furnished by the division for such purposes and shall contain such information as the director may require, including the expiration month chosen by the applicant.

II.  Such registration shall be valid for up to 6 successive months from the date of issuance, and shall not be eligible for successive renewals.

III.  No insurer of a vehicle belonging to any owner or lessee who obtains a seasonal registration and who applies for or receives a reduced automobile insurance premium on account thereof shall be required to provide any contractual coverage, whether in the form of the provision of a defense or the payment of first-party or third-party benefits or otherwise, to the owner or lessee in connection with any event occurring during that part of the year in which the vehicle is not registered.  Owners or lessees of motorcycles registered under this section shall be treated, for purposes of RSA 264:1 through RSA 264:24-b, as a person who does not own that vehicle and has no duty to carry financial responsibility on it for that part of the year.

4  Effective Date.  This act shall take effect July 1, 2019.

METHODOLOGY:

This bill allows for the seasonal registration of motorcycles.  Under this bill, registrants may elect to register their motorcycle between one to six months, instead of a full year. The Department of Safety reports this bill will require programming changes to their registration system (MAAP) and Department forms at an estimated cost of $116,250 in FY 2020.  These estimated expenditures include the following: $70,000 in programming costs to enable the system to delineate seasonal registrations from annual and allow registrations to end on a month other than the owner’s birth month; $26,250 in system testing for each plate type added to this program; and $20,000 to develop and supply new forms to all Division of Motor Vehicle locations and municipal agents.  Additionally, this bill may increase local government expenditures as municipalities modify their registration systems to adhere to this bill.

 

The Department reports this bill will have no impact on state revenue, since the state’s $15 flat fee per motorcycle is not impacted by this bill.  However, the Department reports local motorcycle permit fees are dependent on the number of months the motorcycle is registered.  Therefore, local revenue is likely to decrease under this bill.
