This bill establishes the position of communications director and transfers the funding for such position.  This bill also clarifies the title of a current position in the insurance department.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to positions within the insurance department.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Insurance Department; Communications Director; Position Established.

I.  There is established within the insurance department the unclassified position of communications director.  The communications director shall be qualified to hold that position by reason of education and experience and shall perform such duties and exercise such powers as the commissioner may authorize.

II.  The salary of the communications director shall be determined after assessment and review of the appropriate temporary letter grade allocation in RSA 94:1-a, I(b) for the position which shall be conducted pursuant to RSA 94:1-d and RSA 14:14-c.  Upon completion of this action and appointment of the communications director, position #10949 shall be abolished to allow for the transition of this classified position with its available appropriations into the unclassified position of communications director.  Funding shall be transferred into a new expenditure class 011, within accounting unit 02-24-24-240010-2520.  The incumbent in the abolished position shall be offered the position of communications director.

2  Insurance Department; Department Positions.  Amend RSA 400-A:6, VII to read as follows:

VII.  The commissioner shall appoint, as the commissioner's assistants, a director of financial regulation, a director of health economics, a director of health care analytics, a general counsel, an insurance fraud [attorney] director, a senior insurance fraud investigator, a property and casualty actuary, a chief property and casualty actuary, a workers' compensation analyst, a chief life, accident and health actuary, a compliance and enforcement counsel, a chief financial examiner, a communications director, and a health reform coordinator, each of whom shall serve at the pleasure of the commissioner.  The director of financial regulation, director of health economics, director of health care analytics, general counsel, insurance fraud [attorney] director, senior insurance fraud investigator, property and casualty actuary, chief property and casualty actuary, workers' compensation analyst, chief life, accident and health actuary, compliance and enforcement counsel, chief financial examiner, communications director, and health reform coordinator, shall perform such duties and exercise such powers as the commissioner may authorize.

3  Compensation of State Officers.  Amend RSA 94:1-a, I(b), salary grade FF to read as follows:

FF Insurance department insurance fraud [prosecutor] director

4  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill establishes the unclassified position of Communications Director within the Insurance Department, abolishes a classified position and transfers the remaining appropriations for the abolished classified position to fund the new unclassified position.  The incumbent in the abolished position shall be offered the new position.  The bill also renames the position of Insurance Fraud Attorney to Insurance Fraud Director with no change in salary grade.

 

The Department of Administrative Services states the incumbent in the classified position to be abolished is currently compensated at labor grade 30, step 5 or $72,910 with a salary range of $61,308 to $84,142.  The bill does not designate a letter grade for the new unclassified position, but provides for salary assignment after assessment and review in accordance with RSA 94:1-d and RSA 14:14-c.  The Department indicates it is not possible to determine in advance if the appropriation for the classified position to be abolished will be sufficient to cover the cost of the new unclassified position.

 

The Insurance Department states changing the title only of the Insurance Fraud Attorney to Insurance Fraud Director will have no fiscal impact as the salary classification will not change.  The Department indicates the impact of converting the classified position to an unclassified position cannot be determined because the salary for the new position will be established pursuant to RSA 94:1-d and RSA 14:14-c.  However, the Department expects the new salary will be commensurate with the salary of the position to be abolished.
