SENATE BILL 99

AN ACT establishing a committee to study allowing the sampling of beer or wine at farmers’ markets, establishing a committee to study powdered or crystalline alcohol, and relative to the definition of alcohol.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT establishing a committee to study allowing the sampling of beer or wine at farmers’ markets, establishing a committee to study powdered or crystalline alcohol, and relative to the definition of alcohol.

Be it Enacted by the Senate and House of Representatives in General Court convened:

267:1 Committee Established. There is established a committee to study allowing the sampling of beer or wine at farmers markets.

267:2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Four members of the house of representatives, 2 of whom shall be members of the commerce and consumer affairs committee, appointed by the speaker of the house of representatives.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

267:3 Duties. The committee shall study allowing the sampling of beer or wine at farmers’ markets. The committee shall seek the participation, input, expertise, and advice of New Futures, the department of agriculture, markets, and food, the liquor commission, the Northeast Organic Farming Association of New Hampshire, the Granite State Brewers Association, the New Hampshire Farm Bureau, the New Hampshire Farmer’s Market Association, and other persons or other entities deemed relevant to the committee’s study.

267:4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the senate member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

267:5 Report. The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2015.

267:6 Committee Established. There is established a committee to study powdered or crystalline alcohol.

I. The members of the committee shall be as follows:

(a) Four members of the house of representatives, 2 of whom shall be members of the commerce and consumer affairs committee, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

III. The committee shall study powdered or crystalline alcohol. The committee’s study shall include, but not be limited to, considering whether the sale of powdered or crystalline alcohol should be banned in New Hampshire or, if not, the regulations that should be in place before the sale of powdered or crystalline alcohol may begin in New Hampshire. The committee shall review legislation relative to powdered or crystalline alcohol established in other states.

IV. The committee shall solicit information from any person or entity the committee deems relevant to its study.

V. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Three members of the committee shall constitute a quorum.

VI. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2015.

267:7 Alcohol; Definition. Amend RSA 175:1, III to read as follows:

III. “Alcohol” means that substance known as ethyl alcohol or hydrated oxide of ethyl alcohol which is commonly produced by the fermentation or distillation of grain, starch, molasses, sugar, potatoes or other substances, including all solids, powders, crystals, dilutions and mixtures of these substances.

267:8 Effective Date. This act shall take effect upon its passage.
