     Provides parents and adult students with simplified method for opting out of release by school district of student information to military recruiters.

An Act concerning access by military recruiters to student information directories and amending P.L.1985, c.51.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.1985, c.51 (C.18A:36-19.1) is amended to read as follows:

     1.    a.   Local school districts in New Jersey are directed to establish policies which would provide military recruiters the same access to school facilities and student information directories that is provided to educational and occupational recruiters pursuant to regulations adopted by the State Board of Education pursuant to the "Administrative Procedure Act," P.L. 1968, c. 410 (C. 52:14B-1 et seq.).  These regulations shall be adopted within 180 days of the effective date of this act.  The policies should be consistent with State and federal right to privacy laws.

     b.    A school district which provides a parent or adult student with a form requesting emergency contact information shall include on the form in a clear and conspicuous manner and in the same size type as the other statements on the form, a statement that the parent or adult student may indicate if any or all types of information about the student in any student information directory is not to be released to military recruiters by checking the box "Do not release contact information."

     2.    This act shall take effect immediately and shall first apply to the first full school year following the date of enactment.

 

 

STATEMENT

 

     Under section 1 of P.L.1985, c.51 (C.18A:36-19.1), a school district is directed to establish policies to provide military recruiters the same access to student information directories that is provided to educational and occupational recruiters.  However, pursuant to State Board of Education regulations at N.J.A.C.6A:32-7.1(g)6, and in compliance with federal law at 20 U.S.C. s.7908, parents or adult students are permitted to opt-out of providing this information to military recruiters.  This bill offers a simplified opt-out method.  A school district that provides a form requesting emergency contact information from parents or adult students is required to include on that form a statement that the parent or adult student may indicate if any or all types of information about the student in any student information directory is not to be released to military recruiters by checking the box "Do not release contact information."
