     Requires hospitals to report to DOH on their supplies of personal protective equipment.

An Act concerning personal protective equipment and supplementing Title 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Department of Health shall require every hospital licensed pursuant to Title 26 of the Revised Statutes to report to the department, on a monthly basis, information on the hospital's supply of personal protective equipment.

     b.    The department shall:

     (1)   be authorized to conduct or cause to be conducted spot checks of hospitals to assure compliance with, and the accuracy and integrity of the information received on personal protective equipment pursuant to, the provisions of subsection a. of this section; and

     2)    compile the reported information by the counties and municipalities where the hospitals are located.

     c.     The department shall publish on its Internet website, and update on a monthly basis, the information received pursuant to subsection a. of this section.  

     d.    As used in this section, "personal protective equipment" means equipment worn to minimize exposure to hazards that cause serious illnesses or infection from viral or communicable diseases, including, but not limited to, disposable gloves, shoe coverings, facial masks, facial shields, safety glasses or goggles, respirators, and surgical gowns.

 

     2.    The Department of Health shall prepare and submit an annual report to the Governor and to the Legislature, pursuant to section 2 of P.L.1991, c.164 27 (C.52:14-19.1), on or before December 1 of each year.  The report shall compile the information received pursuant to subsection a. of section 1 of this act.

 

     3.    The Department of Health, pursuant to the "Administrative Procedures Act," P.L.1968, c.410 (C.52:14B-1 et seq.) shall adopt rules and regulations necessary to effectuate the purposes of this act.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill mandates that the Department of Health (DOH) require every hospital licensed pursuant to Title 26 of the Revised Statutes, on a monthly basis, to report information on their supply of personal protective equipment on a monthly basis.

     As defined in the bill "personal protective equipment" means equipment worn to minimize exposure to hazards that cause serious illnesses or infection from viral or communicable diseases, including, but not limited to, disposable gloves, shoe coverings, facial masks, facial shields, safety glasses or goggles, respirators, and surgical gowns.

     Under the provisions of the bill, the DOH would also: be authorized to conduct or cause to be conducted spot checks to assure compliance with, and the accuracy and integrity of the information received on personal protective equipment pursuant to, the provisions of the bill; compile the reported information by the counties and municipalities where the hospitals are located; publish on its Internet website, and update on a monthly basis, the information received on personal protective equipment; and prepare and submit an annual report on the information complied pursuant to the bill  to the Governor and to the Legislature  on or before December 1 of each year.
