SYNOPSIS

     Requires MVC to provide written knowledge examination online during COVID-19 public health emergency and state of emergency.

An Act requiring the New Jersey Motor Vehicle Commission to provide the written knowledge examination online during the COVID-19 public health emergency and state of emergency.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    During the public health emergency and state of emergency declared on March 9, 2020 by the Governor, pursuant to Executive Order No. 103 and extended, where applicable, by subsequent executive orders and notwithstanding the provision of any other law, rule, or regulation to the contrary, the New Jersey Motor Vehicle Commission shall:

     a.     allow an applicant for a special learner's permit or examination permit to complete the written driver's license knowledge examination, which is required to be successfully completed for the issuance of a special learner's permit or examination permit pursuant to R.S.39:3-10, through a secure Internet website operated by the commission;

     b.    (1)   require an applicant who is 18 years of age or older and is completing the written knowledge examination through a secure Internet website operated by the commission to certify that the applicant did not utilize any reference materials, including but not limited to the New Jersey Driver's Manual, published and made available pursuant to R.S.39:3-41, or receive assistance from another individual while completing the examination; and

     (2)   require a parent or guardian of an applicant who is under 18 years of age and is completing the written knowledge examination through a secure Internet website operated by the commission to certify that the parent or guardian was present while the applicant completed the examination and that the applicant did not utilize any reference materials, including but not limited to the New Jersey Driver's Manual, published and made available pursuant to R.S.39:3-41, or receive assistance from another individual while completing the examination, including the parent or guardian.

 

     2.    This act shall take effect immediately and shall expire on the 31st day following the rescission by the Governor of Executive Order No. 103 of 2020 and any subsequent executive orders extending the public health emergency; or, in the absence of a rescission by the Governor, 1[upon] on the 31st day following1 the termination in any other manner of the declared state of emergency and public health emergency.
