SYNOPSIS

     Requires sentences of imprisonment for committing more than one criminal homicide upon place of public worship or religious organization be served consecutively.

An Act concerning criminal homicide and consecutive sentences and supplementing Title 2C of the New Jersey Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of N.J.S.2C:44-5 or any other provision of law, if a person is convicted of more than one criminal homicide in violation of murder pursuant to N.J.S.2C:11-3, aggravated manslaughter or manslaughter pursuant to N.J.S.2C:11-4, or vehicular homicide pursuant to N.J.S.2C:11-5, committed upon the structure, building or the immediate surrounding area of any structure or building of a church, synagogue, temple, mosque or other place of public worship, or any property owned or leased by a nonprofit, religiously affiliated organization, the sentences of imprisonment for each such criminal homicide shall run consecutively.

 

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill requires that sentences of imprisonment for conviction of more than one criminal homicide committed upon the premises of a church, synagogue, temple, mosque or other place of public worship, or any property owned or leased by a nonprofit, religiously affiliated organization, be served consecutively. 

     The bill provides that any person who commits more than one criminal homicide on the grounds of a place of public worship or of a nonprofit, religiously affiliated organization serve the sentences of imprisonment consecutively.  The bill specifies that the terms of imprisonment resulting from the convictions of murder pursuant to N.J.S.2C:11-3, aggravated manslaughter or manslaughter pursuant to N.J.S.2C:11-4, or vehicular homicide pursuant to N.J.S.2C:11-5, are to run consecutively.
