An Act concerning business assistance program eligibility and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in P.L.    , c.    (C.        ) (pending before the Legislature as this bill):

     "Business assistance program" or "program" means any program administered by a State agency that provides monetary or financial assistance in any form including, but not limited to, a grant, loan, loan guarantee, tax credit, tax credit transfer, tax exemption, tax deduction, or other monetary or financial benefit awarded to a person or entity to assist the person or entity in the conduct or operation of a business, occupation, trade, or profession in the State.

     "Center" means the Business Action Center established in the Department of State pursuant to Reorganization Plan No. 003-2011.

     "State agency" means any New Jersey principal department or any division, office, agency, bureau, commission, authority, or instrumentality thereof.

 

     2.    a.   The Business Action Center shall develop and publish on its Internet website homepage a single application form to allow a business operating or proposing to operate in this State to submit certain information to the center to determine whether the business may be eligible for a business assistance program administered by a State agency.  The single application form shall be of a form and manner determined by the center.  The center shall review the completed form and, based on the information submitted, determine whether a business that completed the form is eligible for a business assistance program.

     b.    After completing its review and determination, pursuant to subsection a. of this section, the center shall inform the business within 10 business days of receiving a completed application form, in a form and manner determined by the center, whether the business is eligible for one or more business assistance programs and, if so, the name of the program or programs and whether there is any application deadline for each program for which the business is eligible.

 

     3.    This act shall take effect immediately, but shall remain inoperative for 60 days following the date of enactment.

 

STATEMENT

 

     This bill requires the Business Action Center (center) in the Department of State to develop and publish on its Internet website homepage a single application form to allow a business operating or proposing to operate in this State to submit certain information to the center to determine whether the business may be eligible for a "business assistance program," as that term is defined in the bill, administered by a State agency.  The single application form is to be of a form and manner determined by the center.  The center is to review the completed form and, based on the information submitted, determine whether a business that completed the form is eligible for a business assistance program administered by a State agency.

     After completing its review and determination, the bill requires the center to inform the business within 10 business days of receiving a completed application form, in a form and manner determined by the center, whether the business is eligible for one or more business assistance programs and, if so, the name of the business assistance program or programs and whether there is any application deadline for each business assistance program for which the business is eligible.
