     Prohibits business entity that employs undocumented foreign national from performing public contracts or accepting certain benefits from State or local public agency.

An Act prohibiting a business entity that employs an undocumented foreign national from performing public contracts or accepting certain benefits from a State or local public agency and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  A business entity that employs an undocumented foreign national shall not enter into any contract with, or accept any grant, loan, tax deferral, tax reduction, tax abatement, subsidy, or guarantee from, the New Jersey Economic Development Authority, any other State agency, or any local public agency and shall not employ any undocumented foreign national during the duration of a contract or the period of time during which it receives any such benefit.

     b.  A business entity shall certify in writing, prior to entering into any contract or receiving any benefit included in subsection a. of this section, that it has verified the immigration status of its employees and will not be in violation of that subsection if it enters into a contract or accepts a benefit and will not employ any undocumented foreign national during the duration of a contract or the period of time during which it receives any benefit.

     c. As used in this section:

     "business entity" means any natural or legal person, business corporation, professional services corporation, limited liability company, partnership, limited partnership, business trust, association or any other legal commercial entity organized under the laws of this State or of any other state or foreign jurisdiction;

     "local public agency" means any county, municipality, district, school district or other political subdivision of the State, and any agency, authority, or instrumentality of the foregoing, including, but not limited to, any county improvement authority and any economic development agency, authority, or other entity;

     "State agency" means any of the principal departments in the Executive Branch of the State Government, and any division, board, bureau, office, commission or other instrumentality within or created by such department, and, to the extent consistent with law, any interstate agency to which New Jersey is a party, any public institution of higher education, independent State authority, commission, instrumentality or agency; and

     "undocumented foreign national" means a person who is a citizen of a foreign nation and who does not have the legal right to reside or work in the United States in accordance with federal law.

 

     2.  This act shall take effect immediately.

STATEMENT

 

     This bill prohibits a business entity that employs an undocumented foreign national from performing public contracts or accepting any grant, loan, tax deferral, tax reduction, tax abatement, subsidy, or guarantee from a State or local public agency, including the New Jersey Economic Development Authority.  A business entity must certify in writing, prior to entering into any contract or receiving any benefit, that it has verified the immigration status of its employees and will not be in violation of the bill's provisions if it enters into a contract or accepts a benefit and will not employ any undocumented foreign national during the duration of a contract or the period of time during which it receives any benefit.
