SYNOPSIS

     Grants civil immunity to members of professional licensing boards under certain circumstances.

An Act concerning immunity for members of the professional licensing boards and supplementing P.L.1978, c.73 (C.45:1-14 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Any member, director, consultant, or employee of a professional or occupational licensing board designated in section 2 of P.L.1978, c.73 (C.45:1-15) shall not be liable in any action for damages to any person for any action taken or recommendation made within the scope of his function as a member, director, consultant, or employee of that board, if the action was taken or recommendation was made without malice.  The Attorney General shall defend the person in any civil suit arising from his function as a member, director, consultant, or employee of the board, and the State shall provide indemnification for any damages awarded.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that any member, director, consultant, or employee of a professional or occupational licensing board shall not be liable to any person for damages, for action taken or recommendation made within the scope of that position, if the action taken or recommendation was without malice.

     In addition, the bill provides that the Attorney General shall defend, and the State shall provide indemnification for any damages awarded against, any member, director, consultant, or employee of a professional or occupational licensing board in any civil suit against that person arising from his position.
