     Requires inclusion of senior citizen and disability status in foreclosure case information statement.

An Act concerning foreclosures among senior citizens and persons who are disabled and supplementing chapter 50 of Title 2A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Administrative Office of the Courts shall require the plaintiff and defendant to indicate if the defendant is 65 years of age or older, and provide the disability status of the defendant, in the foreclosure case information statement required pursuant to the Rules of Court.  This requirement shall apply to a foreclosure action that involves an owner-occupied residential mortgage. 

 

     2.    This act shall take effect on the first day of the fourth month next following enactment. 

 

 

STATEMENT

 

     This bill directs the Administrative Office of the Courts to require the creditor and homeowner to provide the homeowner's disability status, and indicate whether or not they are 65 or older, in the foreclosure case information statement required by the Rules of Court.  This requirement would apply to a foreclosure action that involves an owner-occupied residential mortgage.  The purpose of this bill is to facilitate the collection of reliable information on foreclosures among senior citizens and persons who are disabled.
