SYNOPSIS

     Requires Attorney General prepare pamphlets providing information on State laws relating to rights and privileges accorded to service dogs.

An Act concerning service animals and supplementing the "Law Against Discrimination," P.L.1945, c.169 (C.10:5-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.     The Attorney General shall prepare and make available, both in print and in an easily printable format on Department of Law and Public Safety's Internet website, information on the rights and privileges accorded to service dogs and their owners in the State of New Jersey.

     b.    The information shall include, but not be limited to, State laws and regulations relating to access by a service dog and its owner to any place of public accommodation or any vehicle used for public transportation services or for providing transportation to a person with a disability, and the legal ramifications of denying use of, or entry to, a service dog and its owner to any place of public accommodation or any vehicle used for public transportation services or for providing transportation to a person with a disability.

     c.     The Attorney General shall:

     (1)   prepare an informational pamphlet that contains the information posted on Department of Law and Public Safety's website pursuant to subsection a. of this section, and shall update the pamphlet as necessary;

     (2)   require the distribution of the pamphlet, at no charge, during the inspection of a place of public accommodation or any vehicle used for public transportation services or for providing transportation to a person with a disability, as applicable; and

     (3)   make additional copies of the pamphlet available to places of public accommodation and companies and corporations providing public transportation services or providing transportation to persons with disabilities, upon request.

 

     2.    The Attorney General, in consultation with the Chief Administrator of the Motor Vehicle Commission and the Commissioners of Human Services and Transportation, shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to effectuate the purposes of this act including, but not limited to, the manner in which the informational pamphlet would be distributed pursuant to paragraph (2) of subsection b. of section 1 of this act, and other public transportation concerns.

 

     3.    This act shall take effect immediately.

STATEMENT

 

     This bill requires the Attorney General to prepare and make available, both in print and in an easily printable format on the Department of Law and Public and Safety (DLPS) Internet website, information on the rights and privileges accorded to service dogs and their owners in the State of New Jersey.

     Specifically, the pamphlet would provide information on State laws and regulations relating to access by a service dog or its owner to any place of public accommodation or any vehicle used for public transportation services or for providing transportation to a person with a disability, and the legal ramifications of denying use of, or entry to, a service dog and its owner to such places or vehicles.
