SYNOPSIS

     Prohibits application of neonicotinoids on State, county, or municipal property.

An Act concerning the application of neonicotinoids and supplementing P.L.1971, c.176 (C.13:1F-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Within 180 days after the effective date of P.L.    , c.    (C.      ) (pending before the Legislature as this bill), the department shall adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations: (1) establishing a list of chemicals that belong to the neonicotinoid class of chemicals; and (2) prohibiting the application of a neonicotinoid on any property owned or controlled by the State, a county, or a municipality.

     b.    No person shall apply a neonicotinoid that is on the list adopted by the Department of Environmental Protection pursuant to subsection a. of this section on any property owned or controlled by the State, a county, or a municipality. 

     c.     The Department of the Treasury, in consultation with the Department of Environmental Protection, may issue any guidance, or adopt rules or regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), as may be necessary for the implementation of this section. 

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would prohibit the use of neonicotinoids on any lands owned or controlled by the State, a county, or a municipality.  The bill would direct Department of Environmental Protection (DEP) to establish a list of chemicals that belong to the neonicotinoid class of chemicals to be included in the prohibition.  Additionally, the bill provides that the Department of the Treasury, in consultation with the DEP, may issue any guidance, or rules or regulations as may be necessary for the implementation the bill.

     Neonicotinoids are a group of widely used insecticides.  Neonicotinoids are absorbed by plants and can be present in pollen and nectar, which is a threat to bee populations.  Research suggests that neonicotinoids have an adverse impact on pollinating insects, and may contribute to the disappearance of bee populations and colony collapse disorder.
