CURRENT VERSION OF TEXT

     As introduced.

An Act concerning the State Lottery and amending P.L.1970, c.13.

Be It Enacted by the Senate and General Assembly of the State of New Jersey:

     1.  Section 17 of P.L.1970, c.13 (C.5:9-17) is amended to read as follows:

     17.  a.  Unclaimed prize money for the prize on a winning ticket or share shall be retained by the director for the person entitled thereto for [1] one year after the drawing in which the prize was won.  If no claim is made for said money within such year, the prize money shall be allocated to State institutions and State aid for education in the same manner as lottery proceeds are allocated for such purposes under this act.

     b.  The director shall pay any licensed lottery sales agent who sold the winning ticket or share the percentage, commission, or bonus the lottery sales agent is entitled to receive, even if the winner does not claim the prize.

(cf: P.L.2017, c.98, s.13)

     2.  This act shall take effect immediately.

STATEMENT

Under current law, if a lottery winner does not claim the prize on a winning ticket, the lottery sales agent of that ticket does not receive the agent's percentage, commission, or bonus for selling that ticket.  Under the bill, the Division of the State Lottery is required to provide a lottery sales agent with the agent's percentage, commission, or bonus for selling that ticket even if the winner does not claim the prize.
