SYNOPSIS

     Authorizes municipalities to request certain information from transient space marketplaces.

An Act concerning the rental of residential property through a transient space marketplace and supplementing chapter 48 of Title 40 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  As used in this section, "transient space marketplace" means a marketplace accessed via an Internet website, through which a person may offer transient accommodations or hotel rooms to individuals.  A "transient space marketplace" allows transient accommodations or hotel rooms to be advertised or listed through an online marketplace in exchange for consideration or provides a means for a customer to arrange for the occupancy of the transient accommodation or hotel room in exchange for consideration.  A "transient space marketplace" shall not include an online marketplace operated by or on behalf of a hotel or hotel corporation that facilitates customer occupancy solely for the hotel or hotel corporation's owned or managed hotels and franchisees, and shall not include a travel agency or an online travel agency.

     b.  The governing body of a municipality may request from any transient space marketplace the address of each real property located in the municipality that is, or has been, offered for rent on the transient space marketplace.  Such a request may be for the addresses listed within the municipality during any period of time, including an entire calendar year.

     c.  The governing body of a municipality making a request for information pursuant to subsection b. of this section shall make its request to a transient space marketplace in writing.

     d.  The transient space marketplace shall respond to the governing body's request as soon as possible, but not later than 24 hours after it determines, in response to a municipal request, that a property located in the municipality has been posted for rent on its website.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would permit the governing body of a municipality to request from any transient space marketplace the address of each real property located in the municipality that is offered for rent on the transient space marketplace.  A municipality may make a request for any period of time, including an entire calendar year.

     The governing body of a municipality seeking this information would be required to make a request to a transient space marketplace in writing.

     The transient space marketplace would be required to respond to the governing body's request as soon as possible, but not later than 24 hours after it determines that a property located in the municipality has been posted for rent on its website.
