SYNOPSIS

     Requires the placement of defibrillators on certain trains.

An Act concerning the placement of defibrillators on certain trains and supplementing P.L.1979, c.150 (C.27:25-1 et seq.), P.L.1964, c.64 (C.32:1-146.8 et seq.), and Title 32 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. Within two years of the effective date of this act, the corporation shall supply and maintain an automated external defibrillator, as defined in section 2 of P.L.1999, c.34 (C.2A:62A-24), on every train set used to provide rail passenger service.  Each such defibrillator shall be maintained in an accessible location and shall be made available at all times during which the train set is in operation and used by the general public.  The corporation shall ensure that each such defibrillator is tested and maintained and shall provide notification to the appropriate first aid, ambulance or rescue squad, or other appropriate emergency medical services provider of the type and location of the defibrillators in accordance with the provisions of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     b.    The corporation shall ensure at all times during which the train set is in operation that an employee is present who is trained in cardio-pulmonary resuscitation and the use of a defibrillator.  The corporation shall arrange for the training in cardio-pulmonary resuscitation and the use of a defibrillator for authorized employees, fare enforcement officers, and any other staff member designated by the corporation.  The training shall be in accordance with the provisions of subsection a. of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     c.     The corporation and its employees shall be immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C.2A:62A-27).

     d.    For the purposes of this section:

     "Authorized employee" and "fare enforcement officer" shall have the meaning prescribed for those terms by section 1 of P.L.1997, c.357 (C.27:25-5.6); and

     "Train set" means a locomotive and any accompany railroad car, passenger car, or other car in the train or a string of connected railroad cars.

 

     2.    a.  Within two years of the effective date of this act, the port authority shall supply and maintain an automated external defibrillator, as defined in section 2 of P.L.1999, c.34 (C.2A:62A-24), on every rapid transit train set used to provide rail passenger service at or in the Hudson Tubes and Hudson Tubes extensions operated by the Port Authority Trans-Hudson Corporation ("PATH"). Each such defibrillator shall be maintained in an accessible location and shall be made available at all times during which the rapid transit train set is in operation and used by the general public.  The port authority shall ensure that each such defibrillator is tested and maintained and shall provide notification to the appropriate first aid, ambulance or rescue squad, or other appropriate emergency medical services provider of the type and location of the defibrillators in accordance with the provisions of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     b.    The port authority shall ensure at all times during which the rapid transit train set is in operation that an employee is present who is trained in cardio-pulmonary resuscitation and the use of a defibrillator. The port authority shall arrange for the training in cardio-pulmonary resuscitation and the use of a defibrillator for authorized employees and any other staff member designated by the port authority.  The training shall be in accordance with the provisions of subsection a. of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     c.     The port authority and its employees shall be immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C.2A:62A-27).

     d.    As used in this section:

     "Rapid transit train set" means a string of connected passenger cars in the rapid transit train.

 

     3.    a.  Within two years of the effective date of this act, the port authority shall supply and maintain an automated external defibrillator, as defined in section 2 of P.L.1999, c.34 (C.2A:62A-24), on every rapid transit train set used by the authority in the transportation of passengers.  Each such defibrillator shall be maintained in an accessible location and shall be made available at all times during which the rapid transit train set is in operation and used by the general public.  The port authority shall ensure that each such defibrillator is tested and maintained and shall provide notification to the appropriate first aid, ambulance or rescue squad, or other appropriate emergency medical services provider of the type and location of the defibrillators in accordance with the provisions of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     b.    The port authority shall ensure at all times during which the rapid transit train set is in operation that an employee is present who is trained in cardio-pulmonary resuscitation and the use of a defibrillator. The port authority shall arrange for the training in cardio-pulmonary resuscitation and the use of a defibrillator for authorized employees, and any other staff member designated by the port authority.  The training shall be in accordance with the provisions of subsection a. of section 3 of P.L.1999, c.34 (C.2A:62A-25).

     c.     The port authority and its employees shall be immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C.2A:62A-27).

     d.    As used in this section:

     "Port Authority" means the Delaware River Port Authority.

     "Rapid transit train set" means a string of connected passenger cars in the rapid transit train.

     "Transportation of passengers" and "passenger transportation" shall mean the transportation of passengers by rail or other facilities.

 

     4.    Section 1 of this act shall take effect immediately; section 2 of this act shall take effect upon the enactment into law by the State of New York of legislation having an identical effect with section 2, but if, on the date of enactment of this act, the State of New York has already enacted such legislation, section 2 of this act shall take effect immediately; and section 3 of this act shall take effect upon the enactment into law by the Commonwealth of Pennsylvania of legislation having an identical effect with section 3, but if, on the date of enactment of this act, the Commonwealth of Pennsylvania has already enacted such legislation, section 3 of this act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require the New Jersey Transit Corporation, the Port Authority of New York and New Jersey, which operates the PATH trains, and the Delaware River Port Authority, which operates the PATCO speedline, to supply and maintain an automated external defibrillator on every railroad train set or rapid transit train set used by these entities within two years of the effective date of this bill.  This bill defines a train set as a means a locomotive and any accompany railroad car, passenger car, or other car in the train or a string of connected railroad cars and a rapid transit train set as a string of connected passenger cars in the rapid transit train.

     This bill requires each of these entities to maintain each such  defibrillator in an accessible location on each train set, to ensure the availability of each such defibrillator at all times during which the train set is in operation and used by the general public, to ensure that at all times that a train set is in operation, an employee is present who is trained in cardio-pulmonary resuscitation and the use of a defibrillator, and to ensure that each defibrillator is tested and maintained.  Each entity is required to provide notification to the appropriate first aid, ambulance or rescue squad or other appropriate emergency medical services provider of the type and location of each defibrillator in addition to providing requisite training in cardio-pulmonary resuscitation and the use of a defibrillator for appropriate employees.

     Finally, the bill specifies that each entity and its employees are immune from civil liability in the acquisition and use of defibrillators pursuant to the provisions of section 5 of P.L.1999, c.34 (C. 2A:62A-27).
