     Prohibits State agencies from including advertisements in mailings to public.

An Act concerning certain mailings by State agencies and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A State agency shall not include any advertisement in a mailing addressed to a member of the public that is paid for by that agency.

     b.    As used in this section:

     "advertisement" means any printed material that is intended to invite or draw the attention of a member of the public to the sale of goods or services by a profit-making enterprise; and

     "State agency" means any of the principal departments in the Executive Branch of the State Government, and any division, board, bureau, office, commission or other instrumentality within or created by such department, any independent State authority, commission, instrumentality or agency, and, to the extent consistent with law, any interstate agency to which New Jersey is a party.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would prohibit a State agency, including an independent State authority, from including any advertisement in a mailing addressed to a member of the public that is paid for by that agency.  The inclusion of advertisements in such a mailing creates a false impression that the State endorses a particular product or service.
