     Requires civil service desk audit of provisional employees after layoff action by local employer.

An Act concerning layoff actions by local employers in the civil service and supplementing Title 11A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    When an appointing authority of a local jurisdiction implements a layoff action, the commission shall order a classification review or desk audit, as appropriate, of all persons in provisional appointments with that employer to ensure that no provisional employee occupies a title formerly held by a recently laid off employee.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that when a local public employer implements a layoff action, the Civil Service Commission will order a classification review or desk audit, as appropriate, of all persons in provisional appointments with that employer to ensure that no provisional employee occupies a title formerly held by a recently laid off employee.  The purpose of the review or audit is to confirm that the layoff action was done in good faith for economic and efficiency reasons.
