     Establishes fine for committing motor vehicle offense that results in collision with bicyclist.

An Act concerning bicycle safety and supplementing Title 39 of the Revised Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    An operator of a motor vehicle who commits a motor vehicle violation under Title 39 of the Revised Statutes shall be subject to a fine of up to $500 when that violation is the proximate cause of a collision or accident with a bicyclist.  The operator of the motor vehicle shall be subject to a penalty under this section regardless of the level of injury to the bicyclist or damage to the bicycle.  Notwithstanding any other provision of law to the contrary, a conviction under this section shall not merge with any conviction for a violation of Title 39 of the Revised Statues or Title 2C of the New Jersey Statutes. 

 

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill establishes a fine of up to $500 for any operator of a motor vehicle who commits a separate motor vehicle offense that is the proximate cause of a collision with a bicyclist.  Under the provisions of this bill, the fine would apply regardless of whether the bicyclist is injured or the bicycle is damaged.
