SYNOPSIS

     Prohibit use of noise cannons to control bird damage in orchards and vineyards.

An Act concerning bird damage control in vineyards and orchards, and supplementing P.L.1983, c.31 (C.4:1C-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any provision of the "Right to Farm Act," P.L.1983, c.31 (C.4:1C-1 et seq.) or any rule or regulation adopted pursuant thereto, to the contrary, the use of noise cannons in vineyards and orchards to protect fruit or other crops from bird damage shall not be considered a protected practice for the purposes of that act.

     b.  The State Agriculture Development Committee shall adopt an agricultural management practice for the control of bird damage to vineyards and orchards.  The agricultural management practice shall prohibit the use of noise cannons or similar devices and instead recommend the use of netting and other non-sound producing methods for such purposes.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that the use of noise cannons would not be considered a protected practice for the purposes of the "Right to Farm Act," P.L.1983, c.31 (C.4:1C-1 et seq.). The bill also directs the State Agriculture Development Committee to adopt an agricultural management practice for the control of bird damage to vineyards and orchards which would:

     1) prohibit the use of noise cannons or similar devices; and

     2) recommend, instead, the use of netting and other non-sound producing methods for such purposes.
