SYNOPSIS

     Requires members of governing boards of public institutions of higher education to complete training program when review by Middle States Commission on Higher Education indicates governance deficiencies.

An Act concerning the training of governing board members of certain public institutions of higher education and supplementing chapter 3B of Title 18A of the New Jersey Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  In the event that the Middle States Commission on Higher Education identifies deficiencies in the governance of a public institution of higher education when conducting its accreditation review of the institution, the members of the governing board of the institution shall be required to complete a training program developed or approved by the Secretary of Higher Education. The training shall address the governance deficiencies identified by the commission.

     The training shall be completed by all members of the institution's governing board no later than 90 days after the date that the commission identifies the deficiencies in the board's governance.

     b.    The secretary shall:

     (1)   prescribe the specific subject matter of the training;

     (2)   provide the training directly or arrange for, or specify, the entity or entities to provide the training;

     (3)   determine whether the members of the governing board require additional training or need to repeat the training on a periodic basis;

     (4)   certify completion of the training for each governing board member upon receipt of documentation thereof, as provided on a form and in a manner prescribed by the secretary, or otherwise arrange for certification by the training entity; and

     (5)   take other such actions as the secretary determines appropriate to effectuate the purposes of this act.

 

     2.    The Secretary of Higher Education shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to effectuate the purposes of this act.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the members of a governing board of a public institution of higher education to complete a training program when the accreditation review of the institution conducted by the Middle States Commission on Higher Education identifies deficiencies in the board's governance.  The training program will be developed or approved by the Secretary of Higher Education and must address the governance deficiencies identified by the commission.

     Under the bill, the secretary would prescribe the specific subject matter of the training, and would determine whether the members of the governing board require additional training or need to repeat the training on a periodic basis.  The secretary could provide the training directly or arrange for, or specify, the entity or entities to provide the training, and will certify completion of the training for each governing board member.

     The bill provides that the training must be completed no later than 90 days after the date that the commission identifies the deficiencies in the board's governance.
