SYNOPSIS

     Requires installation of safety vision panels in certain doors used by staff and students in certain buildings and facilities.

An Act concerning installation of vision panels and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any law, rule, or regulation to the contrary, except as provided in subsection b. of this section, all doors leading into and out of spaces used by students and staff in a building or facility in which training, instruction, or recreation opportunities are provided to persons under the age of 18 years, including, but not limited to, acting, dance, gymnastics, martial arts, music, sports or other physical education, technology instruction, and tutoring and other academic support, shall have a vision panel to allow activities conducted in the space to be monitored from outside of the space. 

     b.    The requirements set forth in this subsection shall not apply to:

     (1) a lavatory, a locker room or changing room, or any other space in which a student would have a reasonable expectation of privacy;

     (2) a space not used by students, including, but not limited to, a maintenance closet, a room dedicated to building equipment, or a storage room; and

     (3) a private home or other dwelling unit, in which a person offers training, instruction, or recreation opportunities to children under the age of 18.

 

     2.    The Commissioner of Community Affairs shall adopt rules and regulations, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to effectuate the purposes of P.L.    , c.     (C.         ) (pending before the Legislature as this bill).

 

     3.    This act shall take effect on the first day of the seventh month next following enactment, except that the Commissioner of Community Affairs may take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill provides that in buildings and facilities in which minor children receive instruction, training, or recreation opportunities, doors leading into and out of spaces used by students and staff would be required to have a clear panel, through which the activities of the occupants may be monitored.

     Under current regulation, doors leading to spaces used by students and staff in public schools are required to have safety vision panels. The regulation excludes lavatories, storage rooms, janitors' closets, instructional spaces under 300 gross square feet, and locker rooms.

     This bill provide a similar requirement for buildings and facilities in which persons under the age of 18 years receive instruction, training, or recreation opportunities, including, but not limited to, acting, dance, gymnastics, martial arts, music, sports or other physical education, technology instruction, and tutoring and other academic support.

     Under the bill, the requirement would not apply to:

     (1) a lavatory, a locker room or changing room, or any other space in which a student would have a reasonable expectation of privacy;

     (2) a space not used by students, including, but not limited to, a maintenance closet, a room dedicated to building equipment, or a storage room; and

     (3) a private home or other dwelling unit, in which a person offers training, instruction, or recreation opportunities to children under the age of 18.
