An Act amending the Fiscal Year 2019 appropriations act, P.L.2018, c.53.

 

     Be It Enacted by the Senate and the General Assembly of the State of New Jersey:

 

     1.    The following language provision in section 1 of P.L.2018, c.53, the annual State appropriations act for Fiscal Year 2019, is amended to read as follows:

STATE AID

The Director of the Division of Local Government Services may permit any municipality that received Regional Efficiency Aid Program funds pursuant to the annual appropriations act for fiscal year 2010, P.L.2009, c.68, to use a portion of Consolidated Municipal Property Tax Relief Aid or Energy Tax Receipts Property Tax Relief Aid, or both Consolidated Municipal Property Tax Relief Aid and Energy Tax Receipts Property Tax Relief Aid, to provide "Regional Efficiency Aid Program" benefits pursuant to P.L.1999, c.61 (C.54:4-8.76 et seq.).

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill amends the Fiscal Year 2019 appropriations act to allow certain municipalities to use Energy Tax Receipts Property Tax Relief Aid (ETR) to provide benefits for the Regional Efficiency Aid Program (REAP).

     As enacted, a language provision in the Fiscal Year 2019 appropriations act authorizes the Director of the Division of Local Government Services in the Department of Community Affairs (DCA) to permit any municipality that received REAP funding pursuant to the Fiscal Year 2010 appropriations act to use a portion of its Fiscal Year 2019 Consolidated Municipal Property Tax Relief Aid (CMPTRA) to provide REAP benefits. 

     The bill amends this language provision to also make possible the use of Fiscal Year 2019 ETR funds to provide REAP benefits.  Specifically, the bill authorizes the director to allow those municipalities which received REAP funding in Fiscal Year 2010 to use the receipts of ETR or CMPTRA, or both ETR and CMPTRA, to provide REAP benefits. 

     Pursuant to the "Regional Efficiency Aid Program Act," P.L.1999, c.61 (C.54:4-8.76 et seq.), REAP provides State funded property tax credits to the residents of certain municipalities which implemented regionalization, consolidation, or shared services initiatives.  According to the DCA State Aid Certification, the following 14 municipalities received REAP funding in Fiscal Year 2010: Hi-nella Borough, Wrightstown Borough, New Hanover Township, Mannington Township, South Hackensack Township, North Hanover Township, Elk Township, Guttenberg Town, Elmwood Park Borough, Weehawken Township, Englewood City, West New York Town, North Bergen Township, and Union City.
