     1.    a.  Notwithstanding the provisions of any law or regulation to the contrary, a board of education and a school bus contractor may permit the child of a school bus driver to ride the school bus with his parent while the parent is providing pupil transportation services.  The child, at all times while the bus is in operation, shall wear a properly adjusted and fastened seat belt or other appropriate child restraint system in compliance with current laws and regulations regarding school bus passengers.

STATEMENT

This bill would allow a board of education and a school bus contractor to permit the child of a school bus driver to ride the school bus with his parent while the parent is providing student transportation services.  The child would be required to wear a properly adjusted and fastened seat belt or other appropriate child restraint system in compliance with current laws and regulations regarding school bus passengers.  Under the bill, either a board of education or school bus contractor, depending on which entity granted permission for the bus driver's child to ride the bus, would assume liability for any injury to the driver's child while riding the school bus, except in instances in which a court determines that liability is attributed to another party.
