SYNOPSIS

     Limits any annual tuition increase charged by school district which permits enrollment of non-resident students to percentage increase in State aid and tax levy of district.

An Act concerning certain tuition charged by school districts and amending N.J.S.18A:38-3.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    N.J.S.18A:38-3 is amended to read as follows:

     18A:38-3. a. Any person not resident in a school district, if eligible except for residence, may be admitted to the schools of the district with the consent of the board of education upon such terms, and with or without payment of tuition, as the board may prescribe.

     If the board prescribes that a person be admitted to the schools of the district with the payment of tuition, any increase in tuition between the prebudget and budget years shall not exceed the percentage increase between the prebudget and budget years in the district's available revenue as measured by the sum of the general fund tax levy and State aid awarded pursuant to P.L.2007, c.260 (C.18A:7F-43 et al.). 

     b.    Any person not resident in a school district, if eligible except for residence, and if that person previously was a resident of the district, shall be admitted to the schools of the district without payment of tuition if that person's parent or guardian is a member of the New Jersey National Guard or a member of the reserve component of the armed forces of the United States and has been ordered into active military service in any of the armed forces of the United States in time of war or national emergency, resulting in the relocation of the student out of the district.  A school district admitting a student pursuant to this subsection shall not be obligated for transportation costs.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     Under current law, a student who is not resident in a school district may be permitted to enroll in the district with the consent of the board of education.  The board of education is permitted to prescribe the terms of the enrollment, including whether or not tuition will be charged.  This bill provides that if the board determines to charge tuition, any annual increase in tuition will not be permitted to exceed the percentage increase in the total State aid and general fund tax levy of the district between the prebudget and budget years.
