SYNOPSIS

     Allows local authorities to permit individuals to park motor vehicles in designated lane between bicycle lane and moving vehicles and to designate certain bicycle lanes with DOT review or approval.

An Act concerning bicycle lanes and permissible parking on streets with bicycle lanes, amending R.S.39:4-135, and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.39:4-135 is amended to read as follows:

     39:4-135.  The operator of a vehicle shall not stop, stand, or park the vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of traffic, on the right-hand side of the road and with the curb side of the vehicle within six inches of the edge of the roadway, except as follows:

     a.     Upon those streets which have been designated by ordinance and have been marked or signed for angle parking, vehicles shall be parked at the angle to the curb designated and indicated by the ordinance and marks or signs.

     b.    Upon one-way streets, local authorities may permit parking of vehicles parallel with the left-hand edge of the roadway headed in the direction of traffic, on the left-hand side of the road and with the curb side of the vehicle within six inches of the edge of the roadway.

     c.     Upon those streets which have bicycle lanes, designated by ordinance and marked as bicycle lanes, local authorities may permit the parking of vehicles in a designated lane, marked with striping, between the bicycle lane and the outer lane of moving vehicles. The parking lane shall be parallel with the right-hand edge of the roadway, and headed in the direction of traffic.

     2.    (New section) a.  Subject to review or approval by the commissioner as required pursuant to subsection a. of R.S.39:4-8, where on-street parking is not permitted, a bicycle lane shall be located parallel with the edge of the roadway, headed in the direction of traffic on the right-hand side of the roadway, and adjacent to the curb or shoulder of the roadway.

     b.    Subject to review or approval by the commissioner as required pursuant to subsection a. of R.S.39:4-8, where on-street parking is permitted, a bicycle lane shall be located parallel with the edge of the roadway, headed in the direction of traffic on the right-hand side of the roadway, and:

     (1)   between the curb or shoulder of the roadway and the parking lane that meets the requirements of subsection c. of R.S.39:4-135; or

     (2)   between the parking lane and the outer lane of moving vehicles.

     c.     Notwithstanding the provisions of R.S.39:4-8, if the commissioner has not reviewed or approved, as required pursuant to R.S.39:4-8, an ordinance, resolution, or regulation concerning the design or installation of a bicycle lane within 60 days of the date the ordinance, resolution, or regulation was submitted to the department, the ordinance, resolution, or regulation shall be deemed reviewed and approved.

 

     3.    This act shall take effect immediately

 

 

STATEMENT

 

     This bill allows local authorities to permit individuals to park vehicles, where on-street parking is permitted, in a designated lane between a bicycle lane and the outer lane of moving vehicles. The parking lane is to be marked with striping and is to be parallel with the right-hand edge of the roadway and headed in the direction of traffic.

     The bill specifies where bicycle lanes may be located on streets where parking is permitted and where street parking is not permitted.  On a street where parking is permitted, a bicycle lane is required to be located parallel with the edge of the roadway, headed in the direction of traffic on the right-hand side of the roadway, and 1) between the curb or shoulder of the roadway and the parking lane or 2) between the parking lane and the outer lane of moving vehicles.  On a street where parking is not permitted, a bicycle lane is required to be located parallel with the edge of the roadway, headed in the direction of traffic on the right-hand side of the roadway, and adjacent to the curb or shoulder of the roadway.

     The bill creates a 60-day deadline for the Commissioner of the Department of Transportation to review or approve an ordinance, resolution, or regulation concerning the design or installation of a bicycle lane.
