     Requires Executive Branch departments or agencies to notify Legislature of completion of certain draft school district audit reports and submit copy of final report to Legislature.

An Act concerning school district audit reports and supplementing Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  (1) Notwithstanding the provisions of any law, rule, or regulation to the contrary, a department or agency of the Executive Branch shall provide written notice to the Director of Public Information in the Office of Legislative Services of the completion of any draft report resulting from an audit of a school district performed by the department or agency or by an external entity on behalf of the department or agency provided that the draft is considered a public record pursuant to the provisions of P.L.1963, c.73 (C.47:1A-1 et seq.).  The department or agency shall provide the notice within 30 days of the completion of the draft report by the department or agency or submission of the draft report by the external entity to the department or agency. 

     (2)   The Director of Public Information in the Office of Legislative Services shall notify the Secretary of the Senate, the Clerk of the General Assembly, and the members of the Legislature of the availability of such draft reports in accordance with procedures established under the provisions of section 2 of P.L.1991, c.164 (C.52:14-19.1).  Upon request, the department or agency shall provide a copy of the draft report.

     b.    (1) Notwithstanding the provisions of any law, rule, or regulation to the contrary, a department or agency of the Executive Branch shall submit to the Legislature a final report resulting from an audit of a school district performed by the department or agency or by an external entity on behalf of the department or agency pursuant to the provisions of section 2 of P.L.1991, c.164 (C.52:14-19.1).  The department or agency shall submit the report within 30 days of the completion of the final report by the department or agency or submission of the final report by the external entity to the department or agency. 

     (2)   The Director of Public Information in the Office of Legislative Services shall notify the Secretary of the Senate, the Clerk of the General Assembly, and the members of the Legislature of the availability of such final reports pursuant to the provisions of section 2 of P.L.1991, c.164 (C.52:14-19.1).

     c.     The provisions of this section shall not apply to an audit report completed pursuant to N.J.S.18A:23-1.

 

     2.    This act shall take effect immediately.


STATEMENT

 

     This bill requires that a department or agency of the Executive Branch notify the Director of Public Information in the Office of Legislative Services within 30 days of completion of any draft report which results from a school district audit, other than the required annual audit, provided that the report is considered a public record.  The bill also requires that a department or agency of the Executive Branch submit any final report which results from a school district audit, other than the required annual audit, to the Legislature within 30 days of completion of the final report.  Under the bill, the Director of Public Information must notify the Secretary of the Senate, the Clerk of the General Assembly, and the members of the Legislature of the availability of the reports.
