        AN ACT to amend the vehicle and traffic law, in relation to the issuance
          of a distinctive license plate for members of the New York state  Elks
          association of the benevolent and protective order of the Elks
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 404-y to read as follows:
     3    § 404-y. Distinctive plates for the New York state Elks association of
     4  the  benevolent  and  protective order of the Elks. 1. Any member of the
     5  New York state Elks association of the benevolent and  protective  order
     6  of  the  Elks  residing  in  this state shall, upon request, be issued a
     7  license plate bearing the words "New York  State"  on  the  top  of  the
     8  license place and "Elks Association" on the bottom of the license plate.
     9  Application  for such license plate shall be filed with the commissioner
    10  in such form and detail as the commissioner shall prescribe,  and  shall
    11  be verified annually by the applicant.
    12    2.  A  distinctive plate authorized by subdivision one of this section
    13  shall be issued upon proof, satisfactory to the commissioner,  that  the
    14  applicant presently is an active member of the New York state Elks asso-
    15  ciation of the benevolent and protective order of the Elks.
    16    3. A distinctive plate issued pursuant to this section shall be issued
    17  in  the same manner as other number plates upon the payment of the regu-
    18  lar registration fee prescribed by section  four  hundred  one  of  this
    19  article,  provided, however, that an additional annual service charge of
    20  fifteen dollars shall be charged for such plate. Provided, however, that
    21  one year after the effective date of this section funds in the amount of
    22  six thousand dollars, or so much thereof as may be available,  shall  be
    23  allocated  to  the  department  to  offset  costs  associated  with  the
    24  production of such license plates.
    25    § 2. This act shall take effect immediately.
