        AN  ACT  to  amend the public health law, in relation to authorizing the
          city of Schenectady to impose fees for the issuance of birth and death
          certificates through local law

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Paragraph  (b)  of  subdivision  3 of section 4173 of the
     2  public health law, as amended by chapter 293 of the  laws  of  2019,  is
     3  added to read as follows:
     4    (b)  Notwithstanding paragraph (a) of this subdivision, in the follow-
     5  ing county jurisdictions the fee shall  be  set  by  the  county  health
     6  commissioner:  Chemung, Monroe, Onondaga, Tompkins; and in the following
     7  local jurisdictions the fee shall be set by the local legislative  body:
     8  city  of Oswego, city of Albany, city of Schenectady.  In such jurisdic-
     9  tions, the fee may be set up to the amount charged by  the  commissioner
    10  as  prescribed  in subdivision two of section forty-one hundred seventy-
    11  four of this title.
    12    § 2. This act shall take effect immediately.
