The commissioner of education is authorized and directed to 2 conduct a survey regarding instruction on the Holocaust within the 3 state. Such survey shall focus on identifying which school districts 4 subject to section eight hundred one of the education law provide 5 instruction on the Holocaust. Such survey shall include as appropriate, 6 questions on how the district is meeting the learning standards for 7 instruction requirements on the Holocaust pursuant to section eight 8 hundred one of the education law. Such survey shall also require an EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD00692-12-2A. 472--C 2 1 attestation from each school district superintendent that indicates 2 instruction related to the Holocaust is provided at all appropriate 3 grade levels in compliance with section eight hundred one of the educa- 4 tion law. 5 § 2. Findings shall include detailed results of the survey, the extent 6 the survey data submitted was compliant with section eight hundred one 7 of the education law, and if needed, recommendations to strengthen 8 provisions of law if not compliant. A report of the findings of such 9 survey shall be delivered to the governor, the temporary president of 10 the senate, the speaker of the assembly, the minority leader of the 11 senate and the minority leader of the assembly the first of January 12 following the effective date of this act or one hundred twenty days 13 after the effective date of this act, whichever is later. 14 § 3. Each school district that does not respond to such survey or does 15 not affirmatively attest that such instruction is provided pursuant to 16 section two of this act shall prepare and implement a corrective action 17 plan to comply with the instruction required by section eight hundred 18 one of the education law. Such corrective action plan shall be submitted 19 for approval by the commissioner of education in a timeframe, and form 20 and format, acceptable to the commissioner. 21 § 4. This act shall take effect immediately.
