STATE OF NEW YORK ________________________________________________________________________ 544 2019-2020 Regular Sessions IN ASSEMBLY (Prefiled) January 9, 2019 ___________ Introduced by M. of A. BRAUNSTEIN -- read once and referred to the Committee on Governmental Operations CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 2 of article 3 of the constitution, in relation to increasing the terms of office of members of the legisla- ture to four years 1 Section 1. Resolved (if the Senate concur), That section 2 of article 2 3 of the constitution be amended to read as follows: 3 § 2. The senate shall consist of fifty members, except as hereinafter 4 provided. The senators [elected in the year one thousand eight hundred5and ninety-five shall hold their offices for three years, and their6successors] shall be [chosen] elected for terms of two years; provided, 7 that senators elected in the year two thousand twenty-one and in subse- 8 quent years thereafter shall hold their offices for four years; 9 provided, further, that in all legislative terms that commence imme- 10 diately following a decennial census year, the term shall be two years. 11 The assembly shall consist of one hundred and fifty members. The assem- 12 bly members [elected in the year one thousand nine hundred and thirty-13eight, and their successors,] shall be [chosen] elected for terms of two 14 years; provided, that assembly members elected in the year two thousand 15 twenty-one and in subsequent years thereafter shall hold their offices 16 for four years; provided, further, that in all legislative terms that 17 commence immediately following a decennial census year, the term shall 18 be two years. 19 § 2. Resolved (if the Senate concur), That the provisions of the fore- 20 going amendments shall apply only to terms of office commencing after 21 such amendments shall have been adopted pursuant to section 1 of article 22 19 of the constitution. 23 § 3. Resolved (if the Senate concur), That the foregoing amendments be 24 referred to the first regular legislative session convening after the 25 next succeeding general election of the members of the assembly, and, in 26 conformity with section 1 of article 19 of the constitution, be 27 published for three months previous to the time of such election.
