STATE OF NEW YORK ________________________________________________________________________ 1329 2021-2022 Regular Sessions IN ASSEMBLY January 8, 2021 ___________ Introduced by M. of A. JONES, GUNTHER, BLANKENBUSH -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to including a represen- tative of the drug or medical device manufacturer industry on the state board of pharmacy The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The opening paragraph of section 6804 of the education law, 2 as added by chapter 987 of the laws of 1971, is amended to read as 3 follows: 4 A state board of pharmacy shall be appointed by the regents on recom- 5 mendation of the commissioner for the purpose of assisting the regents 6 and the department on matters of professional licensing and professional 7 conduct in accordance with section sixty-five hundred eight of this 8 title. The board shall be composed of not less than [nine] ten members, 9 nine of whom shall be pharmacists licensed in this state for at least 10 five years, and one of whom shall be a representative of either drug or 11 medical device manufacturers. An executive secretary to the board shall 12 be appointed by the regents on recommendation of the commissioner and 13 shall be a pharmacist licensed in this state for at least five years. 14 The board shall have power: 15 § 2. The opening paragraph of section 6804 of the education law, as 16 amended by chapter 414 of the laws of 2019, is amended to read as 17 follows: 18 A state board of pharmacy shall be appointed by the regents on recom- 19 mendation of the commissioner for the purpose of assisting the regents 20 and the department on matters of professional licensing and professional 21 conduct in accordance with section sixty-five hundred eight of this 22 title. The 2 initial registered pharmacy technician members of the state board of 3 pharmacy need not be licensed prior to their appointment but shall have 4 met all other requirements of licensure pursuant to section sixty-eight 5 hundred forty-two of this title except for filing an application and 6 paying a fee. An executive secretary to the board shall be appointed by 7 the regents on recommendation of the commissioner and shall be a pharma- 8 cist licensed in this state for at least five years. The board shall 9 provide assistance to the department: 10 § 3. This act shall take effect on the sixtieth day after it shall 11 have become a law, provided, however that section two of this act shall 12 take effect on the same date and in the same manner as section 3 of 13 chapter 414 of the laws of 2019, takes effect.
