        AN  ACT  to  amend the education law, in relation to registered pharmacy
          interns
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. The opening paragraph of subdivision 2 and subdivision 3 of
     2  section  6801 of the education law, the opening paragraph of subdivision
     3  2 as amended by chapter 46 of the laws of  2015  and  subdivision  3  as
     4  added by chapter 563 of the laws of 2008, are amended and a new subdivi-
     5  sion 6 is added to read as follows:
     6    A  licensed  pharmacist  or a registered pharmacy intern may execute a
     7  non-patient specific  regimen  prescribed  or  ordered  by  a  physician
     8  licensed  in  this  state or nurse practitioner certified in this state,
     9  pursuant to rules and regulations promulgated by the commissioner.  When
    10  a licensed pharmacist administers an immunizing agent, he or she shall:
    11    3. No pharmacist or registered pharmacy intern shall administer immun-
    12  izing agents without receiving training satisfactory to the commissioner
    13  and  the  commissioner of health which shall include, but not be limited
    14  to, techniques for screening individuals and obtaining informed consent;
    15  techniques of administration; indications, precautions and contraindica-
    16  tions in the use of agent or agents; record keeping of immunization  and
    17  information;  and  handling emergencies, including anaphylaxis and need-
    18  lesticks.
    19    6. In the case of a registered pharmacy intern, administration must be
    20  conducted in the physical presence of a licensed  pharmacist  authorized
    21  to administer vaccines.

     1    §  2.  This act shall take effect immediately; provided, however, that
     2  the amendments made to section 6801 of the education law made by section
     3  one of this act shall not affect the  expiration  of  such  section  and
     4  shall be deemed expired therewith.
