       AN  ACT  to  amend  the education law, in relation to creation of a free
         tuition continuing education program at the  city  university  of  New
         York for persons sixty years of age and older
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 6206 of the education law is amended  by  adding  a
    2  new subdivision 17 to read as follows:
    3    17.  THE  BOARD  SHALL  FORMULATE  AND  PROMULGATE A PROGRAM TO BECOME
    4  EFFECTIVE AT THE BEGINNING OF THE SCHOOL YEAR NEXT SUCCEEDING THE EFFEC-
    5  TIVE DATE OF THIS SUBDIVISION, WHEREBY RESIDENTS OF THE CITY OF NEW YORK
    6  WHO ARE SIXTY YEARS OF AGE AND OLDER MAY AUDIT OR ENROLL IN CLASSES  FOR
    7  EXAMINATION,  GRADING  AND  CREDIT AT THE CITY UNIVERSITY OF NEW YORK IN
    8  CREDIT OR NON-CREDIT COURSES, WITHOUT PAYMENT OF TUITION OR  OTHER  FEES
    9  AND  CHARGES.  IN  FORMULATING  SUCH  PROGRAM, THE BOARD SHALL TAKE INTO
   10  ACCOUNT (A) DETERMINATION OF ELIGIBILITY, (B) AVAILABILITY OF SPACE, (C)
   11  AVAILABILITY OF INSTRUCTION, (D) CURRICULUM, (E) SCHEDULE AND  (F)  SUCH
   12  OTHER ITEMS WHICH ARE RELEVANT.
   13    S 2. This act shall take effect immediately.
