AN ACT to amend the military law, in relation to extending the period of
time for which public officers and employees shall be paid his or her
salary for military duty
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. The opening paragraph of subdivision 5 of section 242 of
2 the military law, as amended by chapter 161 of the laws of 1984, is
3 amended to read as follows:
4 Every public officer or employee shall be paid his or her salary or
5 other compensation as such public officer or employee for any and all
6 periods of absence while engaged in the performance of ordered military
7 duty, and while going to and returning from such duty, not exceeding a
8 total of [thirty] sixty days or [twenty-two] forty-four working days,
9 whichever is greater, in any one calendar year and not exceeding [thir-
10 ty] sixty days or [twenty-two] forty-four working days, whichever is
11 greater, in any one continuous period of such absence.
12 § 2. Paragraph (a) of subdivision 5 of section 242 of the military
13 law, as amended by chapter 406 of the laws of 2017, is amended to read
14 as follows:
15 (a) Every public officer or employee shall be paid his or her salary
16 or other compensation as such public officer or employee for any and all
17 periods of absence while engaged in the performance of ordered military
18 duty, and while going to and returning from such duty, not exceeding a
19 total of [thirty] sixty days or [twenty-two] forty-four working days,
20 whichever is greater, in any one calendar year and not exceeding [thir-
21 ty] sixty days or [twenty-two] forty-four working days, whichever is
22 greater, in any one continuous period of such absence.
23 § 3. This act shall take effect immediately; provided however that
24 section two of this act shall take effect on the same date and in the
25 same manner as section 1 of chapter 406 of the laws of 2017 takes
26 effect.
