       AN ACT to amend the social services law, in relation to reimbursement to
         social services districts for expenses for the burial of  a  recipient
         of public assistance and care
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 5 of section 141 of the social services law, as
    2  amended by chapter 81 of the  laws  of  1995,  is  amended  to  read  as
    3  follows:
    4    5.  Expenditures  for burial made by social services districts, cities
    5  and towns pursuant to the provisions of this chapter shall, if  approved
    6  by  the  [department]  OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE, be
    7  subject to reimbursement by the state,  in  accordance  with  the  regu-
    8  lations  of  the [department] OFFICE OF TEMPORARY AND DISABILITY ASSIST-
    9  ANCE to the extent of one hundred per centum  thereof  in  the  case  of
   10  needy  Native  Americans  and  members  of  their families residing on a
   11  reservation within the state and fifty per centum in  all  other  cases,
   12  and  such reimbursement shall be claimed and paid in accordance with the
   13  procedure prescribed by and pursuant to section one hundred  fifty-three
   14  OF  THIS ARTICLE.   However, only so much of such an expenditure as does
   15  not exceed [two hundred fifty dollars for  expenditures  made  prior  to
   16  October  first,  nineteen  hundred  eighty-six, four hundred dollars for
   17  expenditures made on and after October first, nineteen  hundred  eighty-
   18  six  and  prior  to April first, nineteen hundred eighty-seven and nine]
   19  FIFTEEN hundred dollars for expenditures made on and after [April first,
   20  nineteen hundred eighty-seven] OCTOBER FIRST, TWO THOUSAND TEN shall  be
   21  subject to reimbursement by the state.
   22    S 2. This act shall take effect October 1, 2010.
