STATE OF NEW YORK ________________________________________________________________________ 5485 2019-2020 Regular Sessions IN ASSEMBLY February 12, 2019 ___________ Introduced by M. of A. SCHMITT -- read once and referred to the Commit- tee on Corporations, Authorities and Commissions AN ACT to amend the public service law, in relation to certain costs and expenses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 1 and 1-a of section 18-a of the public 2 service law, subdivision 1 as amended by section 2 of part NN of chapter 3 59 of the laws of 2009 and subdivision 1-a as added by section 2 of part 4 A of chapter 173 of the laws of 2013, are amended to read as follows: 5 1. All costs and expenses of the department and commission shall be 6 paid pursuant to appropriation on the certification of the chairman of 7 the department and upon the audit and warrant of the comptroller. The 8 state treasury shall be reimbursed therefore by payments to be made 9 thereto from all moneys collected pursuant to this chapter. [The] For 10 state fiscal years beginning prior to April first, two thousand twenty, 11 the total of such costs and expenses shall be borne by the public utili- 12 ty companies (including for the purposes of this section municipalities 13 other than municipalities as defined in section eighty-nine-l of this 14 chapter), corporations (including the power authority of the state of 15 New York), and persons subject to the commission's regulation, to be 16 assessed in the manner provided in subdivisions two, three and four of 17 this section and section two hundred seventeen of this chapter. 18 Provided however for the state fiscal year that begins on April first, 19 two thousand twenty, such assessment shall be in an amount that is fifty 20 percent of the amount calculated in subdivisions two, three and four of 21 this section and section two hundred seventeen of this chapter. Provided 22 further for state fiscal years that begin on and after April first, two 23 thousand twenty-one, the amount of such assessment calculated in subdi- 24 visions two, three and four of this section and section two hundred EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD07821-01-9A. 5485 2 1 seventeen of this chapter shall be zero and all costs of the department 2 and commission shall be paid by the state treasury. 3 1-a. All costs and expenses of the department related to the depart- 4 ment's responsibilities under section three-b of this [chapter] article 5 shall be paid pursuant to appropriation on the certification of the 6 chairman of the department and upon the audit and warrant of the comp- 7 troller. For the state fiscal [year] years beginning on April first, two 8 thousand fourteen and [each state fiscal year thereafter] beginning 9 prior to April first, two thousand twenty-one, payments are to be made 10 from all moneys collected from the Long Island power authority pursuant 11 to this section. The total of such costs and expenses shall be assessed 12 on such authority in the manner provided in subdivisions two, three and 13 four of this section. Provided however for the state fiscal year that 14 begins on April first, two thousand twenty, such assessment shall be in 15 an amount that is fifty percent of the amount calculated in subdivisions 16 two, three and four of this section. Provided further for state fiscal 17 years that begin on and after April first, two thousand twenty-one, the 18 amount of such assessment calculated in subdivisions two, three and four 19 of this section shall be zero and all costs of the department and 20 commission shall be paid by the state treasury. 21 § 2. This act shall take effect immediately.
