       AN ACT to amend the general business law, in relation to requiring mari-
         nas to sell ethanol free gasoline
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  199-o to read as follows:
    3    S  199-O.  ETHANOL FREE GASOLINE SOLD AT MARINAS.  NOTWITHSTANDING ANY
    4  OTHER PROVISION OF LAW, ANY FILLING STATION AS  DEFINED  IN  SUBDIVISION
    5  SIX  OF  SECTION  TWO HUNDRED EIGHTY-TWO OF THE TAX LAW LOCATED WITHIN A
    6  MARINA, MAY MAKE MOTOR FUEL THAT DOES NOT CONTAIN ETHANOL AVAILABLE  FOR
    7  SALE.
    8    S  2.  This  act shall take effect on the ninetieth day after it shall
    9  have become a law.
