       AN  ACT  to amend the education law, in relation to educational programs
         for certain non-English speaking pupils in a city having a  population
         of one million or more
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Section 3204 of the education law is amended  by adding  a
    2  new subdivision 6 to read as follows:
    3    6.    NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, IN A
    4  SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF ONE  MILLION  OR  MORE,
    5  THERE  SHALL  BE  EMPLOYED  IN  EVERY ELEMENTARY SCHOOL WITH NON-ENGLISH
    6  SPEAKING PUPILS AT LEAST ONE TEACHER WHO IS LICENSED  AS  A  TEACHER  OF
    7  ENGLISH AS A SECOND LANGUAGE FOR EVERY FIFTY NON-ENGLISH SPEAKING PUPILS
    8  OR  FRACTION  THEREOF,  IN ACCORDANCE WITH REGULATIONS PRESCRIBED BY THE
    9  COMMISSIONER CONSISTENT WITH THIS SUBDIVISION.
   10    S 2. This act shall take effect on the one hundred twentieth day after
   11  it shall have become a law. Effective immediately, the addition,  amend-
   12  ment  and/or repeal of any rules or regulations necessary for the imple-
   13  mentation of this act on its effective date are authorized to be made on
   14  or before such effective date.
