        AN ACT to amend the vehicle and traffic law, in relation to motor carri-
          ers of stretch limousines

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 509-d of the vehicle and traffic law is amended by
     2  adding a new subdivision 5-a to read as follows:
     3    (5-a) Every motor carrier shall furnish the department,  beginning  no
     4  later  than  July  first, two thousand twenty and annually thereafter, a
     5  list of each altered motor vehicle commonly referred to  as  a  "stretch
     6  limousine"  designed  to carry fifteen or more passengers in addition to
     7  the driver that such motor carrier operates, if any, including the vehi-
     8  cle identification number and registration number of each  such  altered
     9  motor  vehicle, and a list of all drivers such motor carrier employs who
    10  drive such altered motor vehicles and whether such driver  is  qualified
    11  or  has been disqualified to operate such altered motor vehicle pursuant
    12  to this article.
    13    § 2. Subdivision 1 of section 509-m of the vehicle and traffic law, as
    14  added by chapter 675 of the laws of 1985, is amended to read as follows:
    15    1. At least once every three years, review the  bus  driver  files  of
    16  each  motor carrier, provided, however, that the commissioner may review
    17  such bus driver files at his discretion at any other time during regular
    18  business hours.  Provided, however, that the commissioner  shall  review
    19  at  least  annually  the  bus  driver files of each driver employed by a
    20  motor carrier who operates an altered motor vehicle commonly referred to
    21  as a "stretch limousine" designed to carry fifteen or more passengers in
    22  addition to the driver, and annually verify  whether  each  such  driver

     1  holds  a  valid driver's license valid for the operation of such altered
     2  motor vehicle.
     3    § 3. Section 509-m of the vehicle and traffic law is amended by adding
     4  a new subdivision 8 to read as follows:
     5    8.  Maintain  and  annually  update its website to provide information
     6  with regard to each motor carrier that operates altered  motor  vehicles
     7  commonly  referred  to as "stretch limousines" designed to carry fifteen
     8  or more passengers in addition to the driver  that  includes  the  motor
     9  carrier's  name,  location  and  region  of operation including place of
    10  address, whether such motor carrier is in compliance with  this  article
    11  as  required  by section five hundred nine-j of this article in relation
    12  to the operation of such altered motor vehicles, the number  and  nature
    13  of  violations  of  this  article resulting in convictions of such motor
    14  carrier in relation to the operation of such altered motor vehicles, the
    15  number of miles traveled by such altered motor vehicles operated by such
    16  motor carrier in the preceding twelve months, and, with respect to driv-
    17  ers employed by such motor carrier operating such  altered  motor  vehi-
    18  cles,  the  total  number so employed, the number holding valid licenses
    19  which are valid for the operation of such altered  motor  vehicles,  the
    20  number which lack licenses valid for such operation, the number disqual-
    21  ified  from  operating  such  altered  motor  vehicles,  the  number  of
    22  convictions and accidents involving any such  driver  employed  by  such
    23  motor  carrier  during  the  preceding  twelve months, and the number of
    24  convictions and accidents per ten thousand miles traveled.
    25    § 4. This act shall take effect on the one hundred eightieth day after
    26  it shall have become a law. Effective immediately, the addition,  amend-
    27  ment and/or repeal of any rule or regulation necessary for the implemen-
    28  tation  of  this act on its effective date are authorized to be made and
    29  completed on or before such effective date.
