AN ACT to amend the correction law, in relation to prohibiting inmates
from possessing or viewing media that promotes violence or is sexually
explicit
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. The correction law is amended by adding a new section 144
2 to read as follows:
3 S 144. PROHIBITS INMATES FROM POSSESSING OR VIEWING VIOLENT OR SEXUAL-
4 LY EXPLICIT MEDIA. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE
5 CONTRARY, THE COMMISSIONER SHALL PROHIBIT INMATES FROM POSSESSING PUBLI-
6 CATIONS OR MATERIALS THAT PROMOTE VIOLENCE OR ARE SEXUALLY EXPLICIT.
7 INMATES SHALL NOT RECEIVE OR VIEW ANY MOVIES OR TELEVISION SHOWS THAT
8 HAVE A GREATER LEVEL OF VIOLENCE OR SEXUALLY EXPLICIT MATERIAL AS DESIG-
9 NATED IN A PG-13 FILM, AS ESTABLISHED BY THE MOTION PICTURE ASSOCIATION
10 OF AMERICA FILM RATING SYSTEM, OR SOME OTHER NATIONALLY RECOGNIZED FILM
11 RATING SYSTEM, AS DETERMINED BY THE COMMISSIONER.
12 S 2. This act shall take effect immediately.
